PRESIDENT FRANCOIS HOLLANDE TRUMPS WITH A SIX OF HEART

PRESIDENT OF THE FRENCH REPUBLIC FRANCOIS HOLLANDE TRUMPS WITH A SIX OF HEART ON HIS VISIT TO ST-MARTIN,

In The Daily Herald, Saturday May 9th, 2015 edition we quote: “....He announced St-Martin will get the long awaited “Code Natif” that will enable Gendarmes to fine motorists for not paying their road tax. When the road tax first was introduced a legal anomaly prevented Gendarmes from issuing fines.”

I did really heard the president pronounced the word “Natif” (liable of being interpreted in english “Native”.

In reality President Francois Hollande was referring to “Code NATINF” that is no more than a code term used in computer data processing, if not mistaken should be the abbreviation for “NATIONAL INFORMATION”


The creation of a  “Code NATINF” referred too by President Francois Hollande is not a creation in reality of any specific code for the collectivity of St-Martin.

The promise of President Francois Hollande can in reality be interpreted but by the Government of France proceeding simply to the classification, codification as to permit the entry of the collectivity motor vehicles registration proceedings into the French Republic “Code NATINF”

The French Republic “Code NATINF” referred too consist of the listing and codification of all infractions to the “code de la route”, this in the form of a national nomenclature established by the Minister of justice and validated by the “Conseil des ministres”.

This nomenclature that is common to all the Administrations and judicial service and finance service, assure the systematic registration procedures of fines from the issuing by the gendarmes to the final recovery at the finance service.

The problem preventing the gendarmes from issuing fines, is grounded on the fact that the transfer of motor vehicles registration from the State to the Collectivity and the issuing of new number plates by the latter are not integrated in the “Code NATINF”, therefore motorists with number plates issued by the State before the creation of the Collectivity, were legally not in infraction with the law.

Now concerning the “Road tax”. President Francois Holland had never pronounced the words “road tax” known in french as “ Vignette automobile”. He said a “Code Natinf” that would permit the gendarmes to fine “Infractions d'immatriculation” meaning Motor vehicles in registration infraction in regards to the Collectivity issued number plate.

In regards to the EU legislation the implementation of road tax by States members of the EU is an offense to the principle of free circulation and of non-discrimination within the EU.

The Collectivity of St-Martin being classified as integrated in the EU, an Ultra-Peripheral Territory (UPT), is subject to the legislation of the EU.

Therefore the implementation of a road tax in St-Martin is subject to the approval of Bruxelles and in all case can only fall under the derogatory regime of the EU.

This called “vignette automobile” existed in France 1956 to 2000, date when it was abolished under the Leonel JOSPIN government.

So to all those elected members that are today crowing “Cocorico we have won our “road tax” taxation upon the natives of French St-Martin” I say:
Tomorrow you will woke up to the true reality, that your crow of victory over the promised creation of a “Code NATINF” for St-Martin was no more than mistaken a six of hearts the trump card, nine of hearts.
