 INVADED BY STRANGE SPECIES OF BIRDS

For the lack of thrush you eat blackbirds” adverbial translation: “Beggars can't be choosers”,

Are we natives of St-Martin "beggars" within the French Republic and therefore have no say on the becoming of the fauna, flora and marine life of our Homeland?
Today our Island and the people are suffering the backlashes from the invasion of many species of wild animals unknown on the Island up to the last 2 to 7 years, mainly:

-The invasion of a strange species of thrush (Grive)

- The invasion of Blackbirds (Merle), unknown to our Island up to the last two years, yet are published by those that have in hands our fauna as belonging to the wild life of our Island,

- the invasion of Iguanas unknown to the natives before the last seven years, at the same time the mongoose that was the most familiar wild animal on the Island seems to be disappearing.

At the same time we are seeing less and less of our non-migrant birds such as sugar-birds, yellow breast, doves, ground-doves.


For the last two to three years my garden and home are invaded by a species of bird called thrush. Contrary to the thrush known in my days growing up in St-Martin this new species is very fierce, very wicked, very noisy, very invasive and persevering, a character that has nothing in common with our old time species.

It is unknown the number of species of thrush actually existing on the Island, in recent years the thrush in St-Martin without distinction of species has been listed a protected species, while in guadeloupe only certain species are protected, if not mistaken the described species in St-Martin is hunted in Guadeloupe.

In Guadeloupe you may find two species distinguished mainly one from the other by the color of their legs, yellow legs for one, grey legs for the other and seemly a number of sub-species.

The yellow legged thrush is a protected species in Dominica, St-Lucia and Monserrat but not in Guadeloupe.
I have no knowledge about the species that have now invaded my home Garden/Orchard but before I use to be awaken in the morning by the gentle and agreeable cooing of the doves (Turtledoves) perched in trees surrounding my house

Today I'm awaken by the strident and continuous whistling of thrushes that can pursue all through the day.


The fruit trees surrounding my house were for years the “habitat of doves and ground-doves (Ortolan), where they will built their nest, lay, cover and hatch their eggs, at times using the same bird nest year after year. No more, today they are constantly attacked and driven away by this strange species of thrush. I can only see now and again a dove or a ground-dove from a distance.

This seemingly new species of thrush has invaded and decided to be the sole and exclusive host of the fruit trees surrounding my house, no other bird is allowed to trespass on its take over territory.

May a dove attempts to build his nest even upon a brace of the hang-over of my house roof! It immediately falls under the heavy peck of a thrush, the dove leaving the air covered with it feathers from the merciless pecks received from the thrush.

The dove having no other choice than to abandoned his nest, the thrush will take over the spot and start building his own in the same spot wit twigs and little roots. The brace in question being slanted, every piece of twig or root will fall to the ground as the thrush tries to form his nest.

I do not know whether it is a question of lack intelligence or of blind perseverance but every year we can keep a camp fire from the quantity of twigs and roots dropped before our door from the thrush attempting hopelessly to built his nest on the slanted brace of our house roof overhang yet never managing to form a nest.

On the other hand, what have dissuaded the doves from building their nest within the area occupied by these thrushes is the fact that when the dove's eggs hatches the thrush at times would just swallow the newly hatched baby-dove and at other times just pick out the eyes.

Finding a ripe fruit today in your orchard that is not already eating into by these thrushes is a question of luck today, and at times they even would not allow the fruit to ripe.

Contrary to the old time species of thrush known in St-martin, that was rather a very shy species, this species is fierce and will also invade the inside of our home.


In the entrance room of our home my wife usually kept a large wooden fruit dish with all variety of fruits from the home orchard as well as from the market, Today the only fruits that can be kept uncovered are oranges and grapefruits all other fruits including tomatoes and avocados must be either hidden in close cabinets or kept under special wire-net fruit containers.

There is no where inside the house to keep fruits uncovered, Kitchen or bedroom, thrushes will find them. And even when covered, they find a way under the cover to peck out the fruits.

The other wickedness with this species of thrush is that wherever they set inside the house, they let go their shit even in the very fruit dish they eat and shit at the same time.

Thrushes were not unknown to me as I grew up in St-Martin. Behind the home of my grand parents was a huge fig tree bearing little tiny berries that was a food of choice for thrushes and during the mango season I will often come in view of thrushes wherever there was a foliage of mangoes trees.

But never have I witnessed as today, thrushes invading the inside of homes, claiming the exclusivity of home's orchards, fighting and running away other categories of birds, ravaging other birds nest of their newly hatched baby birds etc... This is why I see this thrush as a new species recently introduced on the Island

The thrush was not a bird that was hunted in St-Martin, as a matter of fact most St-Martiners including myself did not know that the thrush was an edible bird until in the late fifties when an important population of Guadeloupe natives was introduced in St-Martin. They hunted the thrush so intensively that in a short time the thrush was practically not seen in St-Martin,

Born and grew up in St-Martin I only knew it existed a bird called “merle” (Blackbird) by getting up by heart French recitations.

Surprisingly In the last two years, I have noticed quite a few blackbirds around on the Island. What surprised me most is few days ago, going to pay my bill at EDF in the Spring/Concordia, was to behold on the little that remains as green grass pasture in the area where usually you will see in particular numerous ground-doves, there were only blackbirds feeding in the spot and place.

I'm not a specialist in species, so I cannot affirm whether this recently introduced blackbird is of the European species or the Caribbean species, but what I Know of Blackbirds is that in guadeloupe exist a species that does not feed only on insects and fruits but also eat bred and meat and this pushes them to attack other birds nests. They often crack open the eggs in process of hatching and devour the baby-birds.


The male is all black and the female dark grey, shaded in certain spots by a dark brown.

There exist also another species of blackbird called the little blackbird of St-Lucia, much resemblance to the Guadeloupe species but the black of the male is shaded by a purplish metallic blue.

This species originated from South America started to migrate up the Caribbean arc from 1899. In 1959 it was as close to us as on the Island of Antigua.

Is this the species that has migrate to our shore in the last two years? I cannot say



What is said of this species is that instead of building its own nest, the female when ready to lay, will prefer to lay its eggs in an other bird's nest, charging that chosen bird to cover its eggs, hatch and raise its little ones as adoptive parents.

What is unfortunate is that the female of this species before laying its eggs, will often empt the chosen nest of its eggs and even baby-birds.

If this is the actually species that we are now seeing in St-Martin, obviously it constitute a threat to the survival of our non-migrant species.

WHERE ARE OUR MONGOOSE (MANGOUSTE)?

Of the last 36 years on my property on friar's Bay hill, rare was the day I haven't seen a mongoose crossing in the bushes until for the last seven years. I cannot remember the last day I have seen a
mongoose any where on the Island.

It might still have mongoose on the Island but it is undeniable that they have fallen from an over-population to an endangered species.

On the other hand, where I use to see mongoose few years ago, today I'm seeing a colony of Iguanas. Even on the road where usually we may cross a mongoose run over by an automobile today in the same place we find run over Iguanas.

HOW OUR ENTIRE ISLAND BECOME INVADED BY IGANAS.

Born and grew up in St-Martin, the first time in my life I have seen an Iguana was around the age of 30 years old and not in St-Martin but on an excursion trip to Les Saintes/Guadeloupe.
Today rare is the day pass-by that I'm not in a battle against Iguanas ravaging my garden and fruits.

Action speaks louder than words. “Beggars can't be Choosers”. 

We the natives have no other choice than to passively suffer the backlashes resulting from the arbitrary policies of the State's in its arbitrary administration of the natural resources of our Island.


A policy of exclusion that can only create a general sense of colonial conquest and oppression directed against the natives. In the name of creation of natural reserves natural zones, the natives are pushed aside as to give place to a lucrative exploitation of natural resources of our Island by a selective elite.

We are not treated in our Homeland as a responsible civilization entitle to the recognition of our legitimate traditional and cultural attachment to the “terroir” of our Island, on the contrary we are simply pushed aside as irresponsible destroyers of our own natural environment,

In recent years, to the exclusion of all native, new settlers have erect themselves as the exclusive protectors of the flora, fauna and marine life of our Island, all tinted by a colonial civilizing mentality in regards of we the natives.

Our Island natural life is not at it's beginning as these new settlers seems to be flashing it in our eyes today. on the contrary, Our natural environment for over three centuries has constituted an integral part of our sense of patriotism, our cherished tang.

Today we have the feeling of amputated native, we have lost our sense of belonging to our Island, we are treated even below the status of foreigners in our homeland, Some seems to be making it their objective to deprive we the natives of the basic of our patriotic pride.

As natives the soil and its natural life have always been the cherished “Terroir” of our forefathers, our attachment has a legitimate tradition, a homeland culture that demand the respect of all.

It is a crime against humanity to separate a people from the management of their natural environment, it is an act of devitalization of a people of the constituent of their patriotic pride.

Any exclusive initiative of a selective few that interferes with the people's life, their tradition, their culture, their attachment to the natural life of their Homeland is simply an act of colonial take-over.

No one can be more qualified to manage and write the history of the fauna, flora and marine life of our Island than we the natives, most of us estate owners and live in daily and traditional communion with our country's climate and natural life, the basic substance of our patriotism.

We denounce the current policy of exclusion in regards of the natives and demand the respect of our legitimate rights to be at the very least consulted in the decisions affecting our natural environment, 

We have the rights to be the deciders on the life of the wild animals population of our Island, to voice our opinion on what can be hunted and what should be protected, what species can be introduced on the Island and what should not be, what species has risen to a state of over-population and therefore destructive to the flora and agriculture of our Island.

It's overdue time to put a stop to the perpetration of the current neocolonialism policy, nihilism.

I felt revolted reading on face-book the comment of a Beauperthuy son of the soil, one of the most generational rooted St-Martiner and grand estate owner of the Island, concerning a “Blackbird” published as belonging to the wild animals life of St-Martin. He claimed and rightfully that he has never known this bird on the Island until in the two last years.

I felt revolted when recently picking up a revue on Saint-Martin's natural reserve with on front page a group photo of the board members, they were all of European complexion, not one of native's ethnic, we just are not counted as responsible people.

It is the negative effect these type of colonization images on the mental of our young people that pushes them to retreat themselves into society's outcast gangs.

My remark may be considered to be superfluous to some but believe me, in my long history of communication with youngsters, these type of images, these type of little society's details are the vehicles of nihilism agents upon the mind of our young people, they constitute the trigger to a sense of self-negation, the annihilation of their faculty of self-esteem and subsequently, a sense of negation regarding life, their own life and the life of others.

Little details, but unfortunately within a colonial context as our Island, evolve a general nihilistic impact in particular upon the youth in quest for identification.

We are all touched by yesterday's tragedy occurred during St-Martin's Fish Day festivity. It is an unforgiven act of violence, there can be no possible excuse to justify the act of one consciously taking the life of another or even of his own life.

Regardless to the status of the perpetrator or of the victim, taken one's life away is an unforgiven sin. Even the death penalty pronounced by a court of justice is an unforgiven act of violence, even one taking away his own life is an unforgiven act of violence..

We did not create life, we have only discovered it,

We have accepted it without questioning it purpose. We should live it out here on earth with the only belief that it is an undisclosed secret of God and of which only he, has the legitimate authority to end it in his own time.

The beginning and the end of man's life here on earth, are God's supreme and exclusive prerogative.

At the end of time all who have trespassed on God's supreme authority over life and death will be equally judged notwithstanding our earthly status or pretense.

On an other hand, throughout the Bible we find many examples in which God has always considered us as a “People” jointly responsible.

The same applies to us today, as a human society, we are in one way or the next, directly or indirectly responsible of the general trend taken by our society. The perpetrator of the crime being the direct unforgiven sinner does not exonerate us as responsible members of the society from all culpability.  God sees us as a People.

In this sense, how much of us as we condemn the criminality trend of our today's youth, question our responsibility, our duty and failure to be uplifting models to our youth, this not in words but in the images we project as adults and the ideals we cherish?

How much of us felt revolted to see that the opening ceremony of the same Fish Day festivity, primarily honoring our fishermen, was hosted not by the daughter of one of our local fishermen, but by a lady of European ethnicity?

Do we have to deny our native's identity and faculties even to host a public ceremony before invited foreign officials, as to prove our loyalty to France?

Wouldn't it been a more uplifting image, a “point de repere” for our youth in their quest for self-esteem to witness one of their own hosting this local festivity?
Was it not possible to find in St-Martin, one daughter resembling out local fishermen and capable of hosting this local cultural event?

We overlook little images as such but it is exactly on these little images that our youngsters find material to build their personality, recognize themselves through their elders and develop a sense of pride a sense of belonging to society and a spirit of hope in attaining an upright standard in society life.

To deprive them of their self-esteem building material then we should not be surprised of them becoming society offenders.

I'm not launching a campaign against you the new settlers on this Island, but simply begging that you may perform your role within the respect of universal values due to all people in their homeland, respect for the natives profound attachment to all the constituent values of their homeland and their rights to be at the very least equal partners in its management.

You can play an active role in society without treating natives as unqualified and irresponsible people.

To expropriate native from their land and strip them of the substance of their patriotic pride of being the legitimate managers of their homeland natural environment is nothing less to the atrocities perpetrated by European colonizers against the first Caribbean's indigenous inhabitants some three to four centuries back.

SEPARATION OF THE STATE FROM THE CHURCH


How Can elected politics leaders at the head of great leading Nations of the World call forth their christian's convictions to justify discriminatory policies leading to crucifixion treatment and suffering against 40% of the World's human population, our Gay Brethren, Gay not by any choice of their Own but by the secret of God's providential doings?


If we believe in the virtue of Jesus Christ Crucifixion, then we cannot continue to overlook in all consciousness of our christian's conviction the suffering of our brethren, of all those who because of their human nature, gays, or social status, or community or ethnicity or Nation of origin, religion etc... all not because of any choice or will of their own but by fate or providence of which only God knows the secret, are condemned in the name of our christian's conviction or morals to suffering and crucifixion spiritually and physically in the same manner as Jesus Christ,

Being a worthy politic leader is to have the capacity and courage to conciliate our christian's convictions with the reality of facts in  society life here on earth, that is primary human beyond being Christian.

Conciliation of our christian's convictions with the politics of the States comes through the entering into our morals, as a fundamental obligation as citizens of a democratic republic, the necessary virtue in all true democracy to observe the separation of the State's politics from the Church's sacraments.

If with the separation between the State and the Church, the distinction between the term “Marriage” heritage of the Church and the terms “Civil Union” prerogative of the State, was unequivocally explicit the war against gay marriage would have not been.


As an example in our French Republic we will not be subject to a double marriage first within the formalities of the State and a second aleatory marriage in the Church.

By so doing the Church Authority in matters of marriage will be unequivocal, one is either married or not.

Under the present concept of "Marriage" the church only claim is upon the fact that "Your marriage is not bless" which is only from the church point of view and not from the couple belief in their union.

With the revolution that is taking place today in the concept of "MARRIAGE"

The big question is : SHOULD THE LAWS OF THE STATE PRECEDE THE CUSTOMS AND MORALS OF THE NATION OR SHOULD IT BE THE OTHER WAY AROUND?

And this leads compulsory the a second question: HOW LONG WOULD IT TAKE FOR THE LAWS OF THE STATE TO ENTER INTO THE MORALS OF THE NATION AND CONDITIONS OUR BEHAVIORS IN SOCIETY LIFE, ONE IN REGARDS OF THE OTHER?

TO RECOGNIZE AND USE MEDICINAL PLANTS

RECOGNIZING DOORSTEPS PLANTS AND THEIR HEALING PROPERTIES

There are many useful plants growing practically at our doorsteps or nearby that everyone should be able to recognize and learn of their
nutritional and healing properties.

Plants have a threefold usefulness:

1- They provide foods and nourishment for man, animals, birds, fishes
2- They purify the Air and the Waters
3- Many provide agencies that are conducive to health and healing. Some assist in cleansing bloodstream and body, thus inhibiting diseases.

It has been well said: “All diseases are curable but not all patients”

To live a healthy life we ought to be observe in our diet life style the 5 fundamental nutritional supplies that are essential to our system:

1- Carbohydrates elements: (Sugar, Starch, etc from fruits, sugar cane, roots crop, pasta..). Our source of energy. Transformed into reserves of glycogen at the level of our liver. This glycogen, our reserves in energy is distributed to our organism as needed. Our blood is the most important supplicant.


2- Fats (lipids): Butter, milk, cheese, oils, eggs, cacao, chocolate,...), rich in calories and vitamins A and D., crucial to the assimilation the carbohydrates elements, fixation of the calcium, overall assure our growing .
3- Nitrogenous elements (protein): meats, eggs, lentil peas “lentilles”). Protein excess is more common than Protein deficiency. Likewise “Fats”, Nitrogenous substances because of their complexity in different acids demand much from our organism to be transformed and play their role that is to repair and protect our cells can intoxicate them and therefore contribute to sclerosis and the aging of our tissue. For this reason it is best likewise vegetarians to recourse to vegetal sources of nitrogenous elements that demand little from our system to be digested and transformed.

4- Mineral salts (Oligo-elements): These are very tiny traces of elements that circulate throughout our system and play an intra-cell catalyst role. Their presence is at the roots of the different formations of ferments that assure our assimilation and digestion. Too numerous to mention all but some: Chlorine, lead, potassium, sodium, calcium, tin, zinc, iron, nickel, copper, aluminium, chrome, phosphorus, arsenic, magnesium, iodine, sulfur, fluorine......


5- Vitamins: As we are talking Plants, let's just as example look at the vitamins contained in a few every day vegetables of our diet:

- Carrots: Vitamins: A, C, B1, B2, PP, - Minerals: Calcium, potassium, Magnesium, iodine

- Green Cabbage: Vitamins: C, B1, B2, PP, K, - Minerals: Sulphur, Calcium, iron

- Spinach: Vitamins: C, PP, K, - Minerals: Of all green vegetable it is the most rich in Iron.


- Tomatoes: Vitamins: C, B1, B2, PP, A, K, - Minerals: Different Acids

- Parsley: Vitamins: C, B1, B2, A, - Minerals: Sulphur, Phosphorus, Chlorine, Sodium, Potassium, Magnesium, Calcium, Iron, zinc, Iodine, Manganese

- Bananas: Vitamins: C, B1,B2, PP, E, - Minerals: Potassium, Sodium, Calcium, Chlorine

- Aubergine (Egg-Plants): Vitamins: C (mostly in the skin), B1, B2, - Minerals: Sulphur, Potassium, Calcium

- Limes: Vitamins: C.

- Oranges: C, B1, K,


THE USE OF PLANTS

When one recourse to the use of plants in his diet or for treatment, the first thing he should bear in mind is: “Because a plant has healing properties that do not means that it cannot leads to harmful effect in the body (poisonous plants) and because a plant is poisonous do not means that it do not has healing properties”

Therefore the question is: How to extract from healing plants their active and useful ingredients? For this reason let us learn a little more about the Healing properties of plants.


It is said that the active ingredient of the same plant can variate due to the:

  • Season, the soil, the age, its vegetation atmospheric circumstances, the time and some even claim the moon it was harvested on, the means of preservation etc.

    For theses reasons it is recommended to gather the medicinal parts when the special juices within the plant are most abundant:
  • Flowers: In the morning, before are after the flowers open completely.
  • Leaves : when fully developed, harvest also in the morning.
  • Aromatic herbs: gather when in flower. Stalks: collect after fruiting.
  • Barks, roots, trunk, branch bark: Collect either the time of flowering or when the fruits are ripened.
  • Rhizomes and roots: Just before flowering

Remember that the quantity of the medicinal plant you use do not hastened or make healing more effective. If taken in disregard of the recommended dose or in excessive quantity, active ingredients can variate from being less effective to ineffective to finally harmful to the body the latter is mostly true for healing plants classified as poisonous.

The use of plants is not recommended for children under 4 years. Plants that are not classified as poisonous may be administered to children in ¼ of adult dose from 4 to 7, and by 1/3 from 7 to 14 and ½ from 14.

  1. PLANTS ACTIVE AND HEALING INGREDIENTS
    The active ingredients found in plants supplies a need that can restore the body to health, they are consisted of the 5 essentials nutritional supplies above mentioned but most important we find: vitamins, mineral salts (Oligo-elements) that usually can be divided in three different classes:
    1 - Carbohydrates : Carbon, hydrogen and oxygen united in an equal proportion of water. Provides to our system the necessary energy: (Starch, cellulose, gum, different types of sugar, etc,). Carbohydrates are nitrogenous free.

    2 – Vegetal acids: Citric acids, tannic acid, gallic acid, oxalic acid etc.

    3 – Different nitrogenous and non-nitrogenous components: Glucose elements, organic iron, calcium, colorant substances, essential oils, fats, resin, latex, quinine, codeine, morphine, albumin, fibrin, etc.

  2. HOW CAN WE EXTRACT THE HEALING INGREDIENTS?

    Note that aluminum vessels should never be used. Glass, stainless steel or good quality enamelware is preferable.
    Normal dosage per liter of water: 20grams if fresh, 10 grams if dried, and can be taken by 4 to 5 cups a day. The most common preparations:

    As teas and tisanes:

    a) HOT INFUSION: Place the useful parts of the plants or herbs in a container, pour over boiling water and cover the recipient and leave steep for at least 15 minutes.

    b) COLD INFUSION (MACERATION): Steep the useful parts of the plants or herbs in home temperature water for several hours

    c) DECOCTION: Usually used in the preparation of tisanes, consist of bringing to boil then simmering for 15-30 minutes (the liquid should reduce by 1/3) the useful parts of the plants for the extraction of its active ingredients. Best when drink the same day but can be kept up to 24 hours.
    Decoction is the best solution for certain hard parts of plants such as the twigs, roots, barks, rhizomes, berries, seeds only release their properties when they are gently simmered for about 30 minutes in boiling water.

    Advantages or Disadvantages between these three different means:

    - Hot infusion: Sterilization can be incomplete but all of the plant active ingredients properties are preserved
    -Decoction: Sterilization is total and the high temperature water dissolve and appropriate the alkaloids and aromatic substances of the plants but certain of the plants Oligo-elements properties can be modified or decomposed.

    -Cold infusion: The tisane can never be bacteriologically sterilized

    As Tincture:

    Put fresh herbs into a screw-top jar, pour over 30% proof alcohol (Vodka preference because tasteless). Steep in a warm place for one month. Shake the jar well every day. After a month strain and store in a dark bottle.

    As Syrup:

    Make a tea (hot infusion), steep for 20minutes, strain into a pan add sugar or honey and stir slowly over heat until syrupy.


    As Juice:

    The plant can be chopped, minced, crushed and then squeezed with a cloth to extract the juice.
    Normal dosage: 5 drops of juice in a tablespoon of water taken every 3 hours.
    Juice must be use as soon as possible after extraction because it oxidizes very quickly and its virtue decline rapidly.

    As Salads:

    Several varieties of vegetables and herbs may be combined to give an even better result.

    In Soups:

    Many herbs which grow wild can be used in soups, stews and other dishes

    As Baths: (full bath, half bath, foot-bath.... hot, tepid or cold):

    Plants and herbs can be used externally with beneficial results by making a strong concoction from them and adding it to bath water.

    Faster elimination of toxic from the body may be secured and the healing process hastened by a simultaneous recourse to internal and external use of plants and herbs.

    Normal dosage per liter of water: 30 to 50, to simmer for 20 to 40 minutes.

    As Poultices (Cataplasms):

    Fresh plants may be applied directly to or over the affected part of the body, whether it is an inflammation, a wound or a painful area.

    Poultices are made by pounding with the use of wooden utensil or macerating the fresh herbs until it is a homogenous mass that may be applied directly to the affected area or applied by means of a clean white cotton cloth.

    Cold poultices have a cooling effect on swollen or inflamed areas and produce good results in neuralgia, contusions (bruises), sprains, rheumatism and gout.

    Hot poultices may be use for painful inflammatory conditions.

    As Gargles:

    A decoction is prepared. If the throat is sore, it is best to use as hot as possible several times a day.

The policy of the Territorial Collectivity of St-Martin today through it's taxation policy is to dissuade the St-Martin people from building there private individual home by submitting them to exorbitant taxation on building permit and property taxes.


Building permit taxation in St-Martin is superior to 230% of the highest rated taxation of a Commune of Guadeloupe or any Commune of France. The same building permit that will cost in taxation to the most 3000,00 Euros in Guadeloupe or any commune of France is taxed to St-Martin's people building their individual Home the exorbitant sum of 7000,00 Euros.


Many St-martiners who had received a building permit, some as far back as 12 years ago are today receiving from the Territorial Collectivity executory notices in the range from 5000 to over 7000 Euros for an average individual home.


Taxation on building permit is legal what is illegal is the calculation modalities used by the Collectivity. remarking that the law allows the grant of exoneration to certain individuals taking into consideration their financial means.


The legal taxation formula is: Valeur Forfaitaire /m2 X Surface Hors Oeuvre Nette (SHON) X taux (decide par les instances locales)


Meaning: Fixed-price/per square meter multiplied by the Net outwork added up floors surface and multiplied by the rate (at the discretion of local authority)


The fixed-price/per square meter variates within 9 categories of constructions in application of the dispositions of article 1585 D.I. Of the “Code General des Impots” and the Tarif per Category is fixed by fiscal law on national level on the 1st of July of every year as a general guide.


The fixed-price per square meter can variate from one Commune to another on a lower scale than the national fixed-price and only in behalf to a specific Communes to a maximum of 10% above the National scale.


The building permit of an individual building a home as principal habitation is classified Category 5.


The taxes retained on building permit are principally:


  1. Taxe locale d'Equipement: Rate: 1% but is allowed to variate up to 5% by deliberation of the Municipal Counsel, tha latter can also decide to renounce to its collection. The funds are destined to finance infrastructure equipments.


  1. Taxe pour le Financement des Conseils d'Architecture, D'Urbanisme et d'Environnement : rate : fixed by the Conseil General (Departmental tax) maximum rate: 0,30%.


  1. Taxe Departementale Des Espaces Naturels Sensibles. Rate fixed by the Conseil General. Maximum rate: 2%. This taxe is to the discretion of the Department (Conseil General)

The “Surface Hors Oeuvre Nette” (Net Outwork floor surface ) is simply an administrative notion and therefore is less than the effective livable surface of the building. For example you may have a two level home with a surface of 112 m2 on the first floor and 100 m2 for the second floor, given a total of 212 m2 livable surface (SHOB). After deduction of areas not taken into consideration for taxable purposes, this may be reduced to a “Surface Hors Oeuvre Nette” of about 90 m2 for the first floor and 80 m2 for the second floor, total 170 m2.


Calculation modalities of the “SHON” is defined by national law “Circulaire 90/80 du 12/11/1990”


Note that by law up to 170 M2/ “Surface Hors Oeuvre Nette” you are under no obligation to go through a certified architect for your building permit application and only floors covered by a roof over 1,80 meters measured at walls height


In respect of the “Code General des Impots” such a Home falls in the Category 5 and the administrative value of the construction, basis for calculation of the different taxes will be calculated in two portions: *(Price-fixed/m2 for year 2007)

  • From 0 to 80m2 at 333 Euros*/m2 = 26 640,00 Euros,

  • and from 81 to 170 m2 at 487 Euros*/m2. = 43 343,00 Euros

Total taxable value = 69 983,00 Euros


For a commune and Department of France applying the basic rates as Saint-Martin the taxes will be as follow:



  • TLE: 69 983,00 X 3% = 2 099, 00 Euros

  • TDCAUE: 69 983,00 X 0,30% = 210,00

  • TDENS: 69 983,00 X 1% = 700,00

Total taxation = 3 009,00 Euros



By the executory notices send out by the Territorial Collectivity the taxation is calculated as follow:


The administrative value of the construction is calculated in contrary to the Code General Des Impots not by the total floors surfaces of the different floors level but by a separated price for each floor level accusing over 46% increase from the first floor to the second floor given the following calculation:

  • First Floor: 90 X 350 Euros = 31 500, 00 Euros

  • Second Floor 80 X 512 Euros = 40 960,00 Euros

    Total value 72 460,00 Euros


Calculation of the taxation by the St-Martin COM:


  • TLE (first floor) 31 500,00 X 3% = 945, 00

  • TLE (Second Floor) 40 960,00 X 3,60% = 1 475, 00

  • TDCAUE: (First floor) 31 500,00 X 0,30% = 95,00

  • TDCAUE: (Second Floor) 40 960,00 X 0,36 = 147,00

  • TDENS: (First Floor) 31 500, 00 X 1% = 315,00

  • TDENS: (Second Floor) 40 960, 00 X 1,20% = 492,00

    Total taxation to be paid = 6 938,00

A St-Martiner wishing to build a 170 square meter individual home for his family is condemned to pay just for the delivery of a building permit the sum 6 938,00 Euros in taxation fees to St-Martin Territorial Collectivity when in respect of the “Code General des Impots” he should have had to pay but 3 009,00 Euros. This means that the COM of St-Martin is applying to the St-Martin's people a rate that is over 230% superior to the legal taxation rate

.

The “SHON” surface is to be replaced by what will be called: “Surface de plancher” defined by articles L.112-1, R.112-1, R.112-2 of the “Code General des impots”. It is calculated by addition of the surface of all the different level floors closed and covered by a roof superior to 1,80 meter height measured by the height of the interior uncovered walls and deduction other areas such as cellar, storage-room .

The application of art. L.112-2 is precised by “Conseil d'Etat” decree.


The framework of the calculation of the taxable surface of the construction and the maximum rates applied are determined by the “Code General des Impots”, fiscal laws and decrees at national level, leaving simply to the Communes, Departments and COM the liberty to variate their policy within the legal framework.

AS LONG AS IT IS TO PRESSURIZE THE UNPRIVILEGED CLASS, THE STATE'S GOVERNMENT WILL ALWAYS GIVE FREE HANDS TO LOCAL LEADERS.

AS LONG AS WE ARE WITHIN THE FRENCH REPUBLIC, ST-MARTIN COM TO ACT WITHIN THE LEGAL FRAMEWORK OF THE LAWS OF THE REPUBLIC.

The COM of St-Martin by deciding to calculate the taxable surfaces separately by each floor level with an abusive tarif increase from one level to another is acting in fierce illegality.

The Jamun plant was introduced in St-Martin some time in the second half of the 1960's, likely from Miami/Florida, the first Jamun tree appeared in Cole Bay and from there has spread all over the Island.


Most people call it Blackberry but this can be mistaken with our indigenous Blackberry tree, of which berries are also edible. Very few of our indigenous Blackberry can be found on the Island

today. I'm sure that 95% to 100% of St-Martiners from my generation down ignore the fact that we have or did had our indigenous Blackberry that is of the same myrtaceae family as the Jamun


Properties of this recently introduced Jamun plant in St-Martin remain very much unknown to the people of St-Martin. Oblivious of the extraordinary properties of the berries, they are considered in St-Martin as a “messy plague” by most people with a tree in their yard, when ever the fruits season comes around. Little do they know that Jamun berries are sold at a high price in many countries where their properties are known, mainly in India, Indonesia, Suriname, and Florida (USA).




The Jamun berry has an unusual taste, but while taking the health factors into consideration, this little berry could blow you away.


The Jamun plant is considered in India and many other countries to be a power house of the health. Mostly famous to be a diabetic fighter (Lowering the sugar level).


The complete Jamun tree is used for treating various disorders of the body organs. The bark, the leaves, the fruits and seeds are widely used from time immortal for the treatment of various diseases.


The blossoms of the tree are an important source of honey.


For these reasons I will like to share with you all a condensed combination of what I happen learn in my researches on this extraordinary Jamun tree on the different Internet sites:

Reproduction: by seeds


Type of Plant: The Jamun is an evergreen tropical tree 50 to 100 feet tall, it always remains laden with green oblong opposite leaves that are smooth, glossy; they have a turpentine smell. Although a tropical tree, it easily grows in sub-tropical climates.

The bark is scaly gray and the trunk forks into multiple trunks about 3 – 5' from the ground.


Origin: This evergreen plant is originally from India and Indonesia


Flowering: Jamun trees blossom once a year from March to May months, the flowers are fragrant white in branched clusters at stem tips.

Fruit: The fruit is oblong to ovoid shape, pink when nearing maturity and purplish-black when ripe. It is a juicy edible berry. In India Jamun berry is referred as a fruit of god, it is believe that Lord Rama used to eat this fruit when he spend his time in the forest for 14 years.


NUTRITIONAL & MEDICINAL PROPERTIES:


Jamun is considered as the most effective traditional medicine, the fruit, the bark, the seeds, the leaves are commonly used for treatments of various disorders of the body. Many research studies have shown that it is one of the best medicine for treatment of diabetes. The connection between Jamun and diabetes is well known, it is a part of home remedy to reduce increased blood sugar levels.


1 – THE JAMUN BERRY:


The Jamun berry has great nutritional values, it is a good source of minerals and vitamins that play an important role in the various functions of our body. These berries are reported to be quite useful for the heart and liver dysfunctions.


The minerals include: Iron, Calcium, Phosphorus, sodium, Potassium, Zinc, Magnesium, Manganese, (antioxidants) and carotene,

The vitamins include: Vitamin A, Vitamin C and Vitamin B (Folic acids/Vitamin B9)


The astringency taste of the fruit is dues to the presence of tannins and gallic acids. The purple color of the berry is is a fruit pigment called anthocyanin.

The ripe berry is a liver stimulant, it is a digestive, light on the stomach, it also works as a carminative. It is good for diabetes, liver and heart toning. Effective in blood purifying and is also effective in the treatment of skin eruption like freckles


Vinegar made from Jamun fruits is administered in case of the enlargement of spleen, chronic diarrhea and urine retention. As a carminative with mild astringent effect, it is effective in the treatment of stomatitis and diuretic, it gives a soothing effect in the digestive system. It is also effective in treating diarrhea and dysentery.


The fruit pulp contains resin, gallic acid and tannin, used with sesame oil is effective in higher fevers. If jamun fruits are taken with okra its blood sugar lowering action is intensified


Water diluted juice is used as a lotion in the treatment of ringworm.


The pulp is also dried with common salt and preserved as digestive powder.


Studies also show that the Jamun berry has anti-cancer and anti-viral potentials, possible due to several bioactive phyto-chemicals including polyphenol contained in the purple pigment of the fruit skin, called anthocyanin and is protective in liver diseases and prevention of liver damage (necrosis – fibrosis)


Research confirms that polyphenol compounds help in preventing of several chronic disease like: Cancer, heart disease, diabetes, and arthritis.


The Jamun fruit is effective in peptic ulcer, it helps to promote the mucosal defensive factors and antioxidants status and decreases lipid peroxide. It has hypoglycemia, anti-inflammatory, anti-bacterial, anti-HIV and anti-diarrheal effects.


Fruit consumption may also provide benefits during chemotherapy and radiation.


WHAT MAKE JAMUN USEFUL FOR DIABETES?


Researches were conducted in laboratories and it was found that Jamun contains an element called glycosides which doesn't let starch to get converted into sugar.

Calcium (15mg), Potassium (55mg), Magnesium (35mg), Phosphorus (15mg), Sodium (26,2 mg), Iron (1 – 2 mg), Vitamin C (18mg), Carotene (48mg), Folic acids (3mg), 62 Kcal. Energy.


2- THE SEED OF THE BERRY:


The seeds of Jamun berries are an effective home remedy commonly used in traditional methods of medicine from time immortal to control diabetes.


The seed of the fruit is rich in protein carbohydrates ( energy-producing compound) and also traces of calcium. The seeds are also rich in alkaloids which have the hypoglycemic effects (reduction in blood sugar)


Jamun seeds when taken regularly has good effect in the control of diabetes, it does not allow the sugar molecules to accumulate in the body.


The seeds are dried and grounded to powder. It is then taken with normal water after being strained to bring down sugar levels in diabetic patients. Taken 3 – 4 times every day, it tones up the liver basically pancreas which is responsible for producing the insulin, the most important hormones which helps to control the sugar level in the blood stream.



WHAT IS INSULIN?


Insulin is an important hormone that is produced by a small clump of pancreatic cells.

The Jamun seed has also gastro-protective properties.


For diarrhea the dried powder of Jamun seeds is mixed with mango seeds powder and honey. A small amount of this mixture should be used twice daily to get relief from diarrhea.


The paste of seeds mashed with water is best for treating ACNE. Jamun seeds powder also helps in clearing skin blemishes left by ACNE and black heads.


Drug Research Institute, Lucknow, show that alcoholic extracts of the seeds, reduce blood sugar levels and glucosuria in diabetic patients (fresh seeds are better than the dried ones to serve this purpose)


A quarter teaspoon of the powdered seeds with one tea spoon of honey could be consumed for fifty days and significant changes in sugar levels can be noticed.


3- THE BARK


The bark of Jamun has astringent, anti-inflammatory, carminative, diuretic, digestive ant constipating properties.


The bark is good for the treatment of thirst ( a diabetic condition mostly), the sore of throat, bronchitis, dysentery, asthma, ulcer and anemia, it also purifies the blood.


The powder of Jamun bark is applied extremely to effectively control bleeding.


A decoction of the bark and powdered seeds is believed to be very useful in the treatment of diarrhea, dysentery and dyspepsia.


A decoction of bark is used in cases of asthma and bronchitis and is gargled or used as a mouthwash for the astringent effect of mouth ulcerations, spongy gums and stomatitis.


It is found that oral administration from the bark and seeds boost insulin levels in diabetics.





4 – THE LEAVES:


Leaves of the Jamun are said to be a natural antibiotic in the nature. The leaves have antibacterial properties and are also used for strengthening teeth and gums.


The leaves are used to treat ulcerative colitis and also as part of herbal tonic preparation in traditional medicine system.


The extract of tender leaves of Jamun and leaves of mango if taken together helps to stop vomiting in jaundice.


Extract of soft mango and Jamun leaves mixed in honey taken twice daily give relief from vomiting and its burning sensation.


Leave's juice is used for gingivitis (bleeding gums). The ash of burn leaves is good for gum and teeth.


Leaves and bark are used for gingivitis.


The leaves are used by women as a feminine as a vaginal-bath to shrink the vagina after given birth or getting rid of mucus and odors. This bath from the jamun leaves is also used at any time to shrink the vagina. This gives the ultimate in sexual pleasure for both partners


The paste of Jamun leaves is very good to dry the pus-filled wounds.


Extracts of the bark, seeds and leaves have been found to cause a marked prolonged decrease in blood sugar and glycouria (sugar in urine)

JAMUN BERRY COULD TREAT BREAST CANCER:


Caroline Killian, a University of Rhode Island undergraduate student with the assistance of URI Pharmacy Professor Navindra Seeram have possibly discovered a new, nontoxic and completely pain-free treatment for breast cancer.


Killian and Seeram tested extracts of the Jamun berry on two breast cancer cell lines. The first was the most common type of breast cancer and the second is a form called “Triple negative”. It is called this because the diagnosis and some treatment options of breast cancer require the presence or absence of three key indicators or receptors. The combination of these receptors usually tells the doctors what type of breast cancer they are dealing with.


But in the case of the “Triple negative” none of these indicators are identifiable, making diagnosis and treatment very difficult. The “triple negative” cell line is clinically characterized as more aggressive. It responds well to typical treatments such as mastectomy or chemotherapy but is more likely to recur.


In collaboration with Lynn Adams, breast Cancer researcher at City of Hope Hospital in California, Killian and Seeram were able to test the effects of the Jamun berry on the growth of these breast cancer cells in cell cultures. They found that these berries had a strong positive effect on both of the cancer cell lines. They found that the berry inhibits cell growth even of this particular aggressive type of breast tumor, for which there is limited therapy.


WHAT IS SO SPECIAL ABOUT THESE BERRIES?


In mashing up the berries, Killian and Seeram were able to extract the berries finest elements. It was found that the pigments of the berries inhibits cancer cell proliferation, which is important for cancer treatment. To put it simply, it is the passionate purple color of this berry that allows it to do the healing.


The fact that violet (Purple) has the shortest wavelengths of all the colors in the visible spectrum (around 400nm) means that it oscillates the fastest, and has the most energy of all colors we can see.
Killian said they don't know exactly why the purple pigment, in particular is responsible, but we do know that the pigments that are responsible for purple, blue and red found in plants have the same molecule called anthocyanin and they are medicinally active.


She pointed out berries in general have been observed to be particularly effective in targeting the reproductive organs, as the phyto-chemicals derived from the berries have been shown to inhibit growth in both prostate and breast cancers.


The Jamun berry will hopefully put an end to chemo treatments, for breast cancer patients at least said Killian since it successfully reacted with both the triple negative and other more common breast cancer forms in laboratory research, it is very possible the berries can provide a safer and viable treatment alternative.


5 – WINE - BEVERAGES - PRESERVES


The Jamun fruit can be processed into excellent quality fermented beverages such as wine, vinegar, cider and non-fermented sauces and beverages such as the pure juice, sherbet and squashes.




HOW TO MAKE THE JUICE?


Squish the ripe berries (With clean hands), add some hot water, leave it overnight and strain it in the morning and squeeze the pulp to get out all of the juice, refrigerate.


HOW TO MAKE WINE?


To make wine, Squish the ripe berries (with clean hands) in a class jar or a stainless steel pot, add hot water, leave it overnight, in the morning add sugar, cover making sure that it is not airtight to avoid explosion when it starts to ferment.


After 16 to 20 days fermentation, strain and squeeze the pulp to get out all the wine. Let it settle in a large class jar and separate daily the wine from its sediment until the wine gain its normal beautiful deep red color. When you are sure that fermentation is over, bottle and let age.


The wine takes 4 to 6 months to be completely fit for consumption but it can be consume after 2 to 3 months.


Remarque: Most home wine makers will add a little yeast to accelerate the fermentation and even some corn meal or soda crackers or bread. But in this case do not let it ferment for more than 15 days else the wine will turn to vinegar.


The Jamun fruit can also be processed into a distinct flavor of: Jams, jellies, syrups. Can also be used to make excellent sorbets.
